1. About these terms
This website is operated by WorkingHomes Pty Ltd (ABN 00 000 000 000) (WorkingHomes, we, us, our). By using the website you agree to these terms. If you do not agree, please do not use the website.
These terms cover the website and the enquiries you make through it. If you become a Client or a Host, your relationship with us is governed by a separate written agreement — the Client Services Agreement or the Host Partner Agreement — and, where there is any inconsistency, that agreement prevails.
2. Our role as a broker
WorkingHomes is an accommodation brokerage and intermediary. We source, arrange and coordinate long-stay accommodation for construction and workforce clients, and we arrange bookings with property owners and managers. We are not a hotel, a real-estate agent, a property manager or an online marketplace, and we do not own or operate the properties we arrange unless we expressly say otherwise in writing. [Confirm whether WorkingHomes contracts as principal with Clients and Hosts, or as agent — this changes the wording of several clauses.]
3. Estimates, calculator and website content
The Savings Calculator and any figures, examples or percentages shown on the website are indicative estimates only. They are based on general assumptions about short-stay platform fees and typical long-stay rates and do not take into account your project, location, dates, room configuration or market conditions at the time. They are not a quote, an offer or a guarantee of any saving, rate or availability, and they are not financial, legal or tax advice.
We take reasonable care to keep the website accurate and up to date, but we do not warrant that it is complete, current or error-free. Content may change without notice.
4. Enquiries, quotes and agreements
- Submitting an enquiry or registration form does not create a booking, a contract or any obligation on either of us.
- Any quote, shortlist or proposal we send is an invitation to proceed, is subject to availability, and is only binding once both parties have signed a written agreement (or accepted it in the manner the agreement specifies).
- You must only submit information that is accurate and that you are entitled to share. If you provide information about other people (for example, crew members), you confirm you are authorised to do so and have told them how we will use it.
- You must be at least 18 years old and acting in a business capacity to make an enquiry through this website.
5. Acceptable use
You must not:
- use the website for any unlawful purpose or in a way that breaches another person's rights;
- submit false, misleading, defamatory or offensive content, or spam, through our forms;
- attempt to gain unauthorised access to the website, its hosting infrastructure or any connected system;
- introduce malicious code, or scrape, harvest or copy website content or data by automated means; or
- interfere with the website's operation or the experience of other users.
6. Intellectual property
All content on the website — including text, graphics, logos, the WorkingHomes name and mark, page designs and code — is owned by or licensed to us and protected by Australian and international intellectual-property laws. You may view, download and print pages for your own business evaluation of our services. You must not otherwise reproduce, modify, distribute or commercially exploit any content without our written permission.
7. Third-party services and links
The website uses third-party services (such as hosting, fonts and analytics) and may link to third-party websites. We do not control and are not responsible for the content, availability or privacy practices of those third parties. Links are provided for convenience and do not imply endorsement.
8. Consumer guarantees and liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot be excluded under the Australian Consumer Law or any other applicable law. Where our liability for breach of a non-excludable guarantee can be limited, it is limited (at our option) to re-supplying the relevant service or paying the cost of having it re-supplied.
Otherwise, to the extent permitted by law, we exclude all liability for any loss or damage (including indirect or consequential loss, loss of profit, business interruption or loss of data) arising from your use of, or inability to use, the website or your reliance on any estimate, figure or content on it. The website is provided "as is" and we do not warrant that it will be uninterrupted, secure or free of errors or viruses.
9. Privacy
We handle personal information in accordance with our Confidentiality & Privacy Policy, which forms part of these terms.
10. Changes to the website and these terms
We may change, suspend or discontinue any part of the website at any time. We may also update these terms; the current version is always published on this page with the "last updated" date shown above, and your continued use of the website after a change constitutes acceptance of the updated terms.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts entitled to hear appeals from them.
